Dear Market Participant, 

We wish to inform you of a recent decision of a DRB, in respect of a Balancing Market Dispute between a Market Participant and SEMO.

In its decision, the DRB confirms (among other things) that the reference in paragraph B.19.5.1(d) of the Trading and Settlement Code to ''equitable basis'' relates to procedural matters and does not afford parties with a substantive remedy in equity.

The relevant Market Participant has issued a notice of dissatisfaction in respect of this DRB decision.

We are issuing this market message in furtherance of the objectives of the Trading and Settlement Code - in particular, to provide transparency in the operation of the Single Electricity Market (paragraph A.2.1.4(e) of the Trading and Settlement Code).
